By opting in to receive text messages from Joseph L. Lin, M.D., Inc., DBA California Oculoplastics and Retina or its subsidiaries and affiliates (“we,” “us,” or “our”) (the “Service”), you agree to these Text Messaging Terms and Conditions (the “Agreement”). This Agreement supplements—but does not replace—our general Terms of Use and Privacy Policy.

IMPORTANT NOTICE: OUR TERMS OF USE REQUIRE DISPUTES TO BE RESOLVED ON AN INDIVIDUAL BASIS, NOT AS A CLASS ACTION, AND THROUGH BINDING ARBITRATION. YOU WAIVE THE RIGHT TO A JURY TRIAL. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE.
1. Consent to Receive SMS and Limitations on Content
By providing your mobile number and opting in, you expressly consent to receive SMS or MMS text messages, including appointment reminders, treatment coordination, administrative notifications, and other transactional communications related to your care. Message frequency may vary. Standard message and data rates may apply.
Text messages are not intended for communicating Protected Health Information (PHI). While we use a third-party platform (Broadvoice) that states it offers HIPAA-compliant infrastructure and Business Associate Agreements (BAAs), text messaging is inherently less secure than other communication channels. Please do not transmit sensitive health details via SMS.
2. SMS Enrollment and Consent
Participation in our SMS Service is voluntary.
- Opt in: By opting in to receive SMS messages from Joseph L. Lin, M.D., Inc dba California Oculoplastics and Retina you agree to receive text messages regarding appointment reminders, treatment coordination, administrative notifications, and other transactional communications related to your care.
Data Rates and Frequency: Standard message and data rates may apply. Message frequency may vary. - Opt out: You can opt out at any time by replying STOP or calling us at 626-653-9395 to request mobile opt out.
You agree to receive one final confirmation message of your opt-out request. - Help: For help please reply HELP or reach out to us at 626-653-9395.
- Consent: Mobile opt in data or consent will not be shared with third parties for marketing or promotional purposes.
3. Phone Number Ownership and Responsibility to Notify
You affirm that the mobile number provided is accurate and that you are the subscriber or customary user of that number. If your number changes or is reassigned, you agree to notify us promptly. Failure to do so may result in unauthorized messages being sent to unintended recipients, for which you are responsible.
4. Eligibility
You must be at least 18 years old to use this Service. You must also be a wireless service subscriber with compatible messaging capabilities. Not all carriers support this service, and message delivery may be delayed or unavailable.
5. Indemnification
You agree to indemnify and hold harmless Joseph L. Lin, M.D., Inc., DBA California Oculoplastics and Retina and our service providers from any claims or liabilities arising from your use of the Service, including violations of state or federal law (e.g., the TCPA) or your failure to update contact information.
6. Limitation of Liability (Service Provider Disclaimer)
Broadvoice, our third-party SMS service provider, is not liable for any disputes, data breaches, or damages arising from your use of the Service. Broadvoice does not assume responsibility for issues between you and Joseph L. Lin, M.D., Inc., DBA California Oculoplastics and Retina. All liabilities remain with our practice unless otherwise required by law.
7. Dispute Resolution and Arbitration
You agree that any disputes related to this Service will be governed by California law and resolved through binding arbitration on an individual basis. You waive any right to participate in a class action or jury trial.
8. Changes to These Terms
We may update these terms at any time. Notice of significant changes will be provided via SMS or through our website. Continued participation in the Service constitutes acceptance of any changes.
